FOR PATIENTS WHO ARE HAVING URGENT OR EMERGENT ISSUES, DIAL 9-1-1 IMMEDIATELY. PLEASE SEEK CARE AT YOUR NEAREST EMERGENCY ROOM FACILITY. THE ALLEVIUS CLINIC PLATFORM IS NOT FOR MEDICAL EMERGENCIES.
Allevius Clinic, LLC Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between Allevius Clinic, LLC ("Allevius," "we," "us," or "our") and you, the individual accessing or using the Allevius Clinic website located at www.alleviusclinic.com and any associated scheduling or patient portal platforms (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree to these Terms, you must promptly exit the Platform and discontinue use of any Services.
1. Formal Acknowledgement
By clicking "Accept," scheduling an appointment, or otherwise accessing our Platform, you acknowledge that you have read and fully accept these Terms of Service, our Privacy Policy, and our HIPAA Notice of Privacy Practices. These documents are incorporated herein by reference and form part of this agreement.
2. About Allevius Clinic, LLC
Allevius Clinic, LLC is a physician-owned and physician-led telehealth practice. Dr. Mehran Bajoghli, a licensed addiction medicine physician, directly provides all clinical services through the Platform. Allevius Clinic, LLC is not a medical group management company and does not use rotating or contracted provider networks. All clinical care is provided directly by Dr. Bajoghli.
Allevius Clinic, LLC provides telehealth evaluation and treatment services for opioid use disorder and substance dependence, including buprenorphine (Suboxone) treatment, to patients physically located in Virginia, Maryland, Pennsylvania, and Florida at the time of the appointment.
3. Ownership of the Platform
The Platform, including all content, text, images, graphics, logos, features, functionality, and any other materials, is owned by Allevius Clinic, LLC and is protected by applicable United States copyright, trademark, and intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, or publicly display any portion of the Platform without our express written consent.
4. Access to the Platform
Third-Party Links
The Platform may contain links to third-party websites, including our telehealth scheduling platform (Healthie). These links are provided for convenience only. Allevius Clinic, LLC does not control, endorse, or assume responsibility for the content, privacy practices, or functionality of any third-party websites. Your use of any third-party website is at your own risk and subject to that website's own terms.
External Services
The Platform may enable access to third-party services, including scheduling, payment processing, and secure video communication tools. You agree to use such external services at your sole risk. Allevius Clinic, LLC is not responsible for examining or evaluating the content or accuracy of any third-party external services and shall not be liable for any actions, errors, or omissions of such third parties.
5. Security and Restrictions
You are prohibited from violating or attempting to violate the security of the Platform, including:
- Accessing data or accounts you are not authorized to access
- Attempting to probe, scan, or test the vulnerability of the Platform or any connected network
- Using automated tools, scrapers, bots, or crawlers to access or copy Platform content
- Interfering with the proper functioning of the Platform or any activity conducted on it
Violations of system or network security may result in civil or criminal liability. Allevius Clinic, LLC reserves the right to investigate suspected violations and cooperate with law enforcement as appropriate.
6. User Account Terms
Your Account
To access certain features of the Platform, including appointment scheduling, you will be required to create an account through our scheduling platform. You agree to:
- Provide true, accurate, current, and complete information when creating your account
- Maintain and promptly update your account information to keep it accurate
- Protect the confidentiality of your account credentials and not share your password with any third party
- Accept full responsibility for all activity that occurs under your account
Allevius Clinic, LLC reserves the right to suspend or terminate any account if information provided is found to be inaccurate, incomplete, or fraudulent.
Age Restrictions
The Platform is not designed for or directed at individuals under the age of 18. By accessing the Platform, you represent and warrant that you are 18 years of age or older. Allevius Clinic, LLC does not knowingly collect personal information from individuals under the age of 18.
7. Consent to Communications
By accessing the Platform and providing your contact information, you consent to be contacted by Allevius Clinic, LLC by phone, SMS, or email for purposes including:
- Appointment reminders and scheduling confirmations
- Follow-up care communications
- General practice and service notifications
Standard message and data rates may apply to SMS communications. You may opt out of marketing communications at any time by replying STOP to any text message or contacting us directly. Please note that opting out of certain communications may affect your ability to receive appointment reminders and other care-related notifications.
Telehealth appointments conducted through the Platform may be recorded for quality assurance and training purposes. By using the Platform, you consent to such recordings. You agree not to independently record your appointment without the express consent of your Provider.
8. Telehealth Services Terms
Risk of Telehealth
By using the telehealth services available through the Platform, you acknowledge the potential limitations and risks associated with telehealth care, including but not limited to:
- Technical limitations, including poor video or audio quality, that may affect the quality of care
- Communication disruptions due to internet connectivity issues
- Delays in evaluation or treatment due to technical failures
- Potential limitations arising from Dr. Bajoghli not having physical access to examine you in person
You understand and accept these limitations as inherent to telehealth care and agree that they do not constitute a deficiency in the services provided by Allevius Clinic, LLC.
Telehealth Eligibility
Telehealth services are available only to patients who are physically located within Virginia, Maryland, Pennsylvania, or Florida at the time of the appointment. Scheduling an appointment does not guarantee that services will be provided. Clinical appropriateness is determined solely by Dr. Bajoghli.
Not a Substitute for Emergency Care
The Platform and the Services provided through it are not intended for medical emergencies or urgent situations requiring immediate intervention. If you believe you are experiencing a medical emergency, call 9-1-1 immediately. Do not use the Platform to seek emergency care.
You should continue to consult with your primary care physician and other healthcare professionals as recommended. Nothing on this Platform should be interpreted as a substitute for in-person evaluation when clinically warranted.
9. Prescription Policy
Certain services available through the Platform may result in a prescription being issued by Dr. Bajoghli when clinically appropriate. You will not receive a prescription unless you have completed a clinical consultation, Dr. Bajoghli has evaluated your case, and he has determined that a prescription is appropriate for you.
If a prescription is issued, it will be transmitted electronically to a pharmacy of your choice or to a mail-order pharmacy. Allevius Clinic, LLC does not guarantee that your chosen pharmacy will fill your prescription. You agree to use any prescribed medication solely for your personal use and in accordance with the instructions provided.
You agree to read all provided medication information and labels carefully and to contact Dr. Bajoghli or a pharmacist if you have any questions about your prescription.
10. Payment Terms
Payment for Services
Payment for services is processed through a secure third-party payment processor integrated with the Platform. By submitting payment, you represent and warrant that:
- The payment information you provide is true, correct, and complete
- You are authorized to use the payment method provided
- Charges incurred will be honored by your financial institution
Allevius Clinic, LLC does not store your credit card or payment account information. Payment information is handled directly by our third-party payment processor.
Insurance Billing
Allevius Clinic, LLC accepts most major commercial insurance plans, traditional Medicare, and Medicaid for patients located in Virginia, Maryland, and Pennsylvania. Self-pay options are available for all patients. It is your responsibility to verify coverage with your insurance plan prior to your appointment. Allevius Clinic, LLC is not responsible for insurance denials or coverage disputes.
Cancellation and No-Show Policy
Cancellations made within 24 hours of a scheduled appointment may be subject to a cancellation fee. Patients who do not appear for a scheduled appointment without prior notice may also be subject to a no-show fee. Please contact Allevius Clinic, LLC at (276) 500-0338 as soon as possible if you need to cancel or reschedule.
Refund Policy
Refunds are handled on a case-by-case basis at the discretion of Allevius Clinic, LLC. Please contact us directly at info@alleviusclinic.com or (276) 500-0338 with any billing questions or concerns. If a billing error has occurred, we will work with you to resolve it promptly.
11. Accuracy of Information
While Allevius Clinic, LLC makes reasonable efforts to ensure the accuracy of information presented on the Platform, we do not warrant that all content is complete, current, or free of errors. Information on the Platform may be updated or changed without notice. If you believe you have identified an inaccuracy, please contact us so that it may be reviewed and corrected.
12. Privacy
Your use of the Platform is governed by our Privacy Policy and HIPAA Notice of Privacy Practices, both of which are incorporated into these Terms by reference. We encourage you to review those documents carefully. All health information you share with Allevius Clinic, LLC in connection with your care is subject to the protections required by the Health Insurance Portability and Accountability Act (HIPAA) and applicable state law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Allevius Clinic, LLC and Dr. Mehran Bajoghli from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Platform or Services
- Your breach of these Terms of Service or our Privacy Policy
- Any false, inaccurate, or misleading information you provide through the Platform
- Any negligent or wrongful act or omission on your part in connection with your use of the Platform
14. Disclaimer of Warranties
ALLEVIUS CLINIC, LLC DOES NOT WARRANT THAT ACCESS TO OR USE OF THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE PLATFORM AND ALL CONTENT AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
ALLEVIUS CLINIC, LLC DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION OBTAINED THROUGH THE PLATFORM. YOU ASSUME SOLE RESPONSIBILITY AND RISK FOR YOUR USE OF THE PLATFORM AND SERVICES.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALLEVIUS CLINIC, LLC AND DR. MEHRAN BAJOGHLI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE MAXIMUM AGGREGATE LIABILITY OF ALLEVIUS CLINIC, LLC TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO ALLEVIUS CLINIC, LLC IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
16. Force Majeure
Allevius Clinic, LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, pandemic or epidemic, war, government action, internet outages, or other events outside our reasonable control. We will make reasonable efforts to notify you and resume services as promptly as practicable.
17. Dispute Resolution
Allevius Clinic, LLC will make good-faith efforts to resolve any disputes or concerns you raise through direct communication. Please contact us at info@alleviusclinic.com or (276) 500-0338 as a first step.
In the event a dispute cannot be resolved informally, both parties agree to attempt mediation before initiating formal legal proceedings. Any unresolved disputes shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Jurisdiction and venue for any legal proceedings shall be in the appropriate courts of Virginia.
18. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of such courts.
19. Modifications
Allevius Clinic, LLC reserves the right to update or modify these Terms of Service at any time. Changes will be posted to this page with a revised effective date. Your continued use of the Platform following the posting of changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
